These General Terms and Conditions of Sale govern the sales of original works, art prints, artistic creations as well as any services offered on the website www.tomcolaux.com.<\/p>\n\n\n\n
All orders imply full and complete acceptance of these Terms and Conditions.<\/p>\n\n\n\n

The works presented on the site are created by Tom Colaux.<\/p>\n\n\n\n
Each artwork is described with the utmost care. The photographs are faithful reproductions, but colors may vary slightly depending on the screen.<\/p>\n\n\n\n
Original works are sold as unique copies unless otherwise stated.<\/p>\n\n\n\n
Art prints are offered in limited editions when mentioned and are signed and numbered.<\/p>\n\n\n\n
Unless otherwise stated, each original artwork comes with a certificate of authenticity signed by Tom Colaux.<\/p>\n\n\n\n
Limited edition art prints also come with a certificate where applicable.<\/p>\n\n\n\n
Prices are expressed in euros.<\/p>\n\n\n\n
Prices are shown inclusive of all taxes where required by law.<\/p>\n\n\n\n
Delivery, insurance, transport or any customs fees are not included unless otherwise stated.<\/p>\n\n\n\n
Prices may be changed at any time without affecting orders already confirmed.<\/p>\n\n\n\n
An order becomes final after validation of the agreed payment or deposit.<\/p>\n\n\n\n
Tom Colaux reserves the right to refuse an order for legitimate reasons.<\/p>\n\n\n\n
Payment can be made by:<\/p>\n\n\n\n
bank card; ;
bank transfer; ;
or any other method offered on the site.<\/p>\n\n\n\n
For some works, a deposit may be required.<\/p>\n\n\n\n
The work remains the property of Tom Colaux until full payment is received.<\/p>\n\n\n\n
The artworks are packaged with the utmost care.<\/p>\n\n\n\n
Delivery times are given as an indication only.<\/p>\n\n\n\n
Tom Colaux cannot be held responsible for delays related to the carrier, customs formalities or force majeure.<\/p>\n\n\n\n
In the event of a damaged package, the buyer is advised to immediately make a claim with the carrier and then contact Tom Colaux as soon as possible.<\/p>\n\n\n\n
The consumer benefits from a legal period of fourteen (14) days when the right of withdrawal is applicable.<\/p>\n\n\n\n
In accordance with European regulations, this right does not apply in particular to:<\/p>\n\n\n\n
to works created on commission; ;
to personalized creations; ;
to goods made according to the customer's specifications.<\/p>\n\n\n\n
Returns must be made in their original condition.<\/p>\n\n\n\n
The works remain the property of Tom Colaux until full payment of the price.<\/p>\n\n\n\n
Purchasing a work of art does not confer any reproduction rights.<\/p>\n\n\n\n
Tom Colaux retains all of his copyrights.<\/p>\n\n\n\n
Any reproduction, distribution, adaptation, commercial exploitation, publication, creation of NFTs, use for training artificial intelligence models or any other use of the work is prohibited without prior written authorization.<\/p>\n\n\n\n
Only the physical ownership of the work is transferred to the purchaser.<\/p>\n\n\n\n
The legal guarantees provided by Belgian law remain fully applicable.<\/p>\n\n\n\n
Any claim must be made within a reasonable time after the discovery of the defect.<\/p>\n\n\n\n
Personal data collected in connection with an order is processed in accordance with the Privacy Policy available on the website.<\/p>\n\n\n\n
Tom Colaux cannot be held responsible for the non-performance of its obligations in the event of force majeure.<\/p>\n\n\n\n
These General Terms and Conditions of Sale are governed by Belgian law.<\/p>\n\n\n\n
The parties agree to seek an amicable solution before any legal proceedings.<\/p>\n\n\n\n
In the absence of an agreement, the Belgian courts shall have sole jurisdiction, unless otherwise required by mandatory provisions.<\/p>\n\n\n\n
