These General Terms and Conditions of Sale govern the sales of original works, art prints, artistic creations as well as any services offered on the website www.tomcolaux.com.

All orders imply full and complete acceptance of these Terms and Conditions.

  1. The works

The works presented on the site are created by Tom Colaux.

Each artwork is described with the utmost care. The photographs are faithful reproductions, but colors may vary slightly depending on the screen.

Original works are sold as unique copies unless otherwise stated.

Art prints are offered in limited editions when mentioned and are signed and numbered.

  1. Certificate of authenticity

Unless otherwise stated, each original artwork comes with a certificate of authenticity signed by Tom Colaux.

Limited edition art prints also come with a certificate where applicable.

  1. Price

Prices are expressed in euros.

Prices are shown inclusive of all taxes where required by law.

Delivery, insurance, transport or any customs fees are not included unless otherwise stated.

Prices may be changed at any time without affecting orders already confirmed.

  1. Order

An order becomes final after validation of the agreed payment or deposit.

Tom Colaux reserves the right to refuse an order for legitimate reasons.

  1. Payment

Payment can be made by:

bank card; ;
bank transfer; ;
or any other method offered on the site.

For some works, a deposit may be required.

The work remains the property of Tom Colaux until full payment is received.

  1. Delivery

The artworks are packaged with the utmost care.

Delivery times are given as an indication only.

Tom Colaux cannot be held responsible for delays related to the carrier, customs formalities or force majeure.

In the event of a damaged package, the buyer is advised to immediately make a claim with the carrier and then contact Tom Colaux as soon as possible.

  1. Right of withdrawal

The consumer benefits from a legal period of fourteen (14) days when the right of withdrawal is applicable.

In accordance with European regulations, this right does not apply in particular to:

to works created on commission; ;
to personalized creations; ;
to goods made according to the customer's specifications.

Returns must be made in their original condition.

  1. Retention of title

The works remain the property of Tom Colaux until full payment of the price.

  1. Copyright

Purchasing a work of art does not confer any reproduction rights.

Tom Colaux retains all of his copyrights.

Any reproduction, distribution, adaptation, commercial exploitation, publication, creation of NFTs, use for training artificial intelligence models or any other use of the work is prohibited without prior written authorization.

Only the physical ownership of the work is transferred to the purchaser.

  1. Guarantee

The legal guarantees provided by Belgian law remain fully applicable.

Any claim must be made within a reasonable time after the discovery of the defect.

  1. Data protection

Personal data collected in connection with an order is processed in accordance with the Privacy Policy available on the website.

  1. Force majeure

Tom Colaux cannot be held responsible for the non-performance of its obligations in the event of force majeure.

  1. Applicable law

These General Terms and Conditions of Sale are governed by Belgian law.

The parties agree to seek an amicable solution before any legal proceedings.

In the absence of an agreement, the Belgian courts shall have sole jurisdiction, unless otherwise required by mandatory provisions.
